Below you will find the delivery conditions of NH Flowers & Collectables BV

The following conditions are valid unless a different agreement has been concluded exclusively in writing. If you have any questions about any of these provisions, you can contact us via info@nhflowers.nl.

NH Flowers is not responsible for any printing, typing, setting or image errors that could unintentionally communicate an incorrect sales price. If this does occur, the price will be adjusted by NH Flowers.

Articles

1. General

1.1. These conditions apply to all offers, orders and agreements of NH Flowers. Unless NH Flowers agrees to other conditions in writing. The customer cannot derive any rights for future transactions from any agreed deviations.

1.2. The sale of an article is concluded after acceptance of the order and confirmation by e-mail. The order confirmation is also the invoice.

1.3. Items must be paid for within a period of max. 4 days. If no payment is received after this period, the order of the item will be cancelled.

1.4. All agreements and disputes between the parties are governed by Dutch law.

1.5. Because the colours of our articles are displayed differently based on the monitor settings and capabilities of the buyer, colour deviations cannot be excluded. You cannot derive any rights from this. It is possible to exchange the article. Of course, our conditions for returns apply (see article 6)

Article 2. Payment

2.1 The prices stated with the articles are in euros and include VAT.

2.2 After placing an order, you will immediately receive a confirmation email with the total costs, including shipping costs. No additional costs are charged for online payments.

2.3 Payment can be made by means of IDeal, credit cards or advance payment. When the payment is received by us, we will ship the order as soon as possible. We strive to offer the ordered item(s) to UPS within 3 working days.

2.4 In case of advance payment, the amount from the confirmation email must be transferred to account number IBAN NL49ABNA0529562448 in the name of NH Flowers, stating the order number from this email.

Article 3. Shipping costs

3.1. For deliveries within the Netherlands, for orders under €50, the shipping costs are €5.00

3.2. For deliveries within the Netherlands, for orders over €50, the shipping costs are €7.50.

3.3. For deliveries outside the Netherlands, but within Europe, the shipping costs are € 15.00 for packages up to 2 kg. If the package is heavier, we will of course send you a full price quote in advance by e-mail.

3.4. For deliveries outside the Netherlands, but within Europe, for orders over €100, shipping costs are free. 3.5. It is also possible to collect the order, provided it has been paid for, in the store. Any shipping costs will then be settled in the store.

Article 4. Cancellation

4.1. It is possible to cancel an order, if this is done within 24 hours after the order has been placed and provided that the order has not yet been sent. This cancellation can be communicated by e-mail or telephone. Unpaid orders can be cancelled free of charge within 24 hours.

4.2. The seller may terminate an order or refuse a buyer without giving reasons.

4.3. If a buyer does not cancel the order within 24 hours, see under 4.1., the buyer is liable for payment. The seller is entitled to charge administration costs to the buyer, if the order is cancelled after 24 hours or is not paid.

4.4. When cancelling a paid order or an item from an order, the following administration costs will be charged to the customer: 1. €1,00 when cancelling an item from an order. 2. €1,50 when cancelling an entire order.

Article 5. Delivery

5.1. We strive to offer orders for shipment within 3 working days after receipt of payment. However, NH Flowers is not obliged to do so. If we deviate from this for certain reasons, you will receive an e-mail message.

5.2. An order will in principle always be sent within 4 working days after receipt of payment. The maximum delivery time is however 30 days after receipt of payment. If the delivery time is longer than 30 days, the buyer has the right to terminate the agreement. No costs will be charged for this.

5.3. If an order consists of multiple products, NH Flowers is entitled to deliver these in parts. NH Flowers will not charge any additional shipping costs for this.

5.4. If articles are unexpectedly not available, this will be communicated by e-mail. The buyer has the possibility to cancel the order, or to order replacement articles, for the same order amount.

5.5. The shipment is carried out in accordance with the GDPR conditions (General Terms and Conditions for the Transport of Goods) of UPC

5.6. All offers listed in our shop are valid until the stated validity date, but can be terminated prematurely by the seller. The offers are valid while stocks last.

5.7. We do our best to keep the website as up-to-date as possible, however it may happen that a product you ordered is unexpectedly no longer available. In this case we will contact you as soon as possible.

Article 6. Returns

6.1. If you do not wish to purchase a product from the webshop for any reason, you have the right to cancel the purchase within 14 days, without giving reasons, and to return the product to NH Flowers after delivery. This is only possible if the buyer has notified NH Flowers of this in advance by e-mail or telephone. Any costs for the return shipment are at your expense. Return shipments are only accepted if the product is undamaged. We request that you do not order multiple items to try them out at home. We are happy to advise you, at home, by telephone 020 226 1226 or by e-mail info@nhflowers.nl

6.2. We do not provide any warranty on discounted items.

6.3. The buyer is responsible for the costs and risk of the return shipment. NH Flowers assumes that the buyer returns the shipment in the same way, and where necessary sends it insured. This can also be done by returning the ordered products to our store in Amsterdam. Upon personal delivery of the products, you will receive a confirmation of receipt. Returns that are sent by post must always be sufficiently stamped; insufficiently stamped returns will never be accepted by NH Flowers and will therefore not be credited. Returns must be provided with a fully completed return form.

Article 7. Liability

7.1 Any liability of NH Flowers, the employees and the products of NH Flowers for all damage, of whatever nature, direct or indirect, including business damage, consequential damage, damage to movable or immovable property or to persons, is expressly excluded. NH Flowers is also not liable for damage caused by third parties during the execution of the agreement.

7.2 NH Flowers accepts no liability for any damage resulting from the use of NH Flowers products.

7.3 Any liability of NH Flowers towards the buyer is in any case limited to a maximum of the invoice amount that the buyer owes to NH Flowers under the relevant agreement.

7.4 NH Flowers is not liable for any misunderstanding, mutilation, delay or improper transmission of orders and communications resulting from the use of the internet or any other means of communication in traffic with NH Flowers or between NH Flowers and third parties, insofar as this relates to the relationship between the customer and NH Flowers, unless and insofar as there is intent or gross negligence on the part of NH Flowers.

7.5 NH Flowers is not liable for the non-permanent availability of www.nhflowers.nl, and for technical or electronic errors in the online offers.
